3. ELIGIBILITY AND GEOGRAPHIC RESTRICTIONS

3.1 California-Only Services
Our Practice is licensed in California only and provides services exclusively to California residents who are physically located within California at the time of service delivery. We do not provide medical services to individuals located outside of California, even if they are California residents.
3.2 Location Verification
By using the Website and accessing services, you represent and warrant that you are physically located in California. We may use technical measures, including IP address verification and geolocation services, to verify your location. Misrepresenting your location is a violation of these Terms and may result in immediate termination of services and account access.

4. USER ACCOUNTS AND PATIENT PORTAL
4.1 Account Creation
To access certain features, including the patient portal, you must create an account. To create an account, you will be required to provide:

4.2 Minor Patient Accounts
For patients under 18 years of age, a parent or legal guardian must create and maintain the patient portal account. The parent or guardian is responsible for all use of the account and must ensure the confidentiality of login credentials. Parents and guardians have full access to their minor child's medical records through the portal, subject to applicable California law regarding minor consent for mental health services.
4.3 Account Security
You are responsible for:

4.4 Account Recovery
If you forget your password or lose access to your account, you may request account recovery by contacting us at drgriffith@gtbpsych.com. We will verify your identity before providing account recovery assistance. Identity verification may include:

4.5 Account Termination and Data Retention
To terminate your patient portal account, please contact us at drgriffith@gtbpsych.com. Please note:

Closing your account does not delete your medical records, which must be retained for a minimum of seven (7) years as required by California law

We will retain your medical records and may retain certain account information as necessary for legal, regulatory, or business purposes

After account closure, you will no longer have portal access, but you may request copies of your medical records in accordance with applicable law

Account data (excluding medical records) will be archived and may be deleted after three (3) years of inactivity, subject to legal retention requirements
5. PROHIBITED USES
You agree NOT to use the Website or App to:

If your insurance or a third party is covering any portion of your treatment costs, you remain ultimately responsible for all charges. We will work with your insurance provider, but any amounts not covered by insurance are your responsibility.
6.4 Refunds and Cancellations

13.2 Jurisdiction and Venue
You agree that any legal action or proceeding arising out of or related to these Terms or the Website or App shall be brought exclusively in the state or federal courts located in Los Angeles County, California. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
13.3 Informal Resolution
Before filing any legal action, you agree to first contact us at drgriffith@gtbpsych.com to attempt to resolve the dispute informally. We will make good faith efforts to resolve any dispute within sixty (60) days. Both parties agree to participate in at least one good faith discussion during this period.
13.4 Mediation
If informal resolution is unsuccessful, the parties agree to attempt to resolve the dispute through mediation before pursuing litigation. Mediation shall be conducted by a mutually agreed-upon mediator in Los Angeles County, California. The costs of mediation shall be shared equally by the parties. Either party may proceed to litigation if mediation does not resolve the dispute within thirty (30) days of the first mediation session.
13.5 Exclusions from Dispute Resolution
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in court to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

14. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
